Commercial Mediation for Businesses, Landlords and Organisations

Man on two Phones

Many disputes between businesses and their suppliers or clients, landlords and their tenants, or partners in a commercial venture end in expensive and time consuming litigation or the beauracracy of the small claims court when they could be resolved by mediation.

Commercial Mediation allows both parties to outline their issues in confidence with one of our professional impartial and independent mediators and seek a mutually agreeable solution. Agreements are often reached far more quickly and at far less cost than going to court. As the agreements are mutual, both parties have a direct stake in making sure they work.

Small Business Mediation

Small businesses in particular can struggle with the time and cost of litigation when things go wrong with a supplier or client. Even where they may be a contract or terms and conditions in place, issues can arise from simple misunderstandings that can result in a major dispute if they are not tackled quickly. Changes in delivery times, specifications, level of service or payment terms can all have a huge impact on a small business, and mediation can offer a fast and effective solution to restoring communication between the parties and get the job back on track.

Landlord and Tenant Mediation

The explosion on the buy-to-let property market over recent years means there are now thousands of new private landlords who may own one or two properties as their long-term investment but are not full-time or experienced property managers. Even with a tenancy agreement in place, different interpretations of the responsibilities of landlord and tenant can quickly result in bitter disputes. Mediation can often diffuse these disputes and open up communication between landlord and tenant where this has broken down. It can help clarify the rights and obligations of both parties, and avoid the need for legal action or threats of eviction.

Commercial Partnerships

More and more these days, different businesses or individuals are working together in order to gain large-scale contracts or tenders that they would not be able to win on their own. The more different partners involved, the more room there is for misunderstandings. Each party needs the specific expertise and experience of the other but may not fully understand what is involved in each role within the partnership. Mediation provides an opportunity to increase understanding and improve communication away from the pressures of delivering the work at hand, and can help avoid costly delays, disputes or disagreements that may result in all those involved losing out.

Costs

Costs for Commercial Mediation vary on a case-by-case basis and whether one or two mediators are required and if joint or separate meetings between the parties are possible. For an initial discussion and further information, please contact us.
